Question:
What is the ruling regarding reciting Tashahhud, before reciting Surah Fatiha, in the third rak’ah of a Fardh salah? Does it necessitate Sajdah Sahw?
Answer:
الجواب باسم ملهم الصواب
- If a person recites Tashahhud before reciting Surah Fatiha in Fardh Salah, no Sajdah Sahw will be necessary to perform. However, if Tashahhud is recited after reciting Surah Fatiha, then Sajdah Sahw must be performed to correct the Salah.
- The above ruling applies only to the first and second rak’ah of Fardh Salah and all rak’at of all other types of Salah, i.e. Sunnah, Nafl and Wajib.
- If, however, someone recites Tashahhud in the third or fourth rak’ah (of Fardh Salah) whilst standing, there is no need to perform Sajdah Sahw – regardless of whether Tashahhud is recited before or after Surah Fatiha.

فتاوى قاسمية: ج 7، ص 579 – 582
قال في الفتاوى الهندية: ولو قرأ التشهد في القيام – إن كان في الركعة الأولى – لا يلزمه شيء، وإن كان في الركعة الثانية اختلف المشايخ فيه، والصحيح أنه لا يجب، كذا في الظهيرية، ولو تشهد في قيامه قبل قراءة الفاتحة فلا سهو عليه، وبعدها يلزمه سجود السهو، وهو الأصح؛ لأن بعد الفاتحة محل قراءة السورة، فإذا تشهد فيه فقد أخر الواجب، وقبلها محل الثناء، كذا في التبيين، ولو تشهد في الأخريين لا يلزمه السهو، كذا في محيط السرخسي. وقال في البحر الرائق: لو تشهد في قيامه بعد الفاتحة لزمه السجود، وقبلها لا على الأصح؛ لتأخير الواجب في الأول وهو السورة، وفي الثاني محل الثناء، وهو منه. وفي الظهيرية: لو تشهد في القيام إن كان في الركعة الأولى لا يلزمه شيء، وإن كان في الثانية اختلف المشايخ فيه والصحيح أنه لا يجب اهـ.
